Re St Andrew Kirk Ella [2011] Mark Hill Dep. Ch. (York)

The rector and churchwardens  sought a faculty for the erection of a church centre by way of a substantial extension to the existing Grade I listed building. The Chancellor granted a faculty.

Re St Columba Drypool [2008] John Collier Ch. (York)

The Chancellor granted a faculty to confirm the renewal and restoration of the 31’ x 21’ mural “Christ in Glory”.

Re St Egelwin the Martyr Scalford [2024] ECC Lei 1

To meet the increased needs of the church and the community, the proposal was for the creation of a meeting room between the vestry and the servery at the west end of the church. The proposed room would have bi-fold doors, which could be opened up to make the room part of the nave when needed. The work would involve re-siting the font. Contentious parts of the proposals were the depth and height of the meeting room and the fact that two pillars at the west end of the church would be obscured. The Chancellor granted a faculty, being satisfied that the justification for carrying out the proposals outweighed any potential harm. 

Re St Guthlac Market Deeping [2024] ECC Lin 2

The Chancellor granted a faculty to authorise the refurbishment of the kerbs surrounding the petitioner’s grandparents’ grave, the removal of a self-seeded tree from the middle of the grave and an additional inscription in memory of the petitioner’s father, whose remains had been interred elsewhere.

Re St John the Baptist Newington [2009] Peter Collier Ch. (York)

Faculty granted for re-ordering, including the creation of a complex of buildings for youth related activities, and removal and disposal of pews from the south aisle.

Re St John the Baptist Penshurst [2014] John Gallagher Ch. (Rochester)

The petitioners wished, amongst other proposals for re-ordering, to remove the choir stalls from the chancel and level the floor, and also remove the Victorian chancel screen, in order to make the church more adaptable for worship, concerts and other uses. The Victorian Society objected to the removal of the chancel screen. Faculty granted.

Re St John the Baptist Penshurst [2015] Court of Arches

An appeal by the Victorian Society against the decision of the Chancellor of the Diocese of Rochester to allow the removal from the church of a Victorian eight bay screen by Bodley & Garner and its reinstallation in a church in Leicestershire, which would necessitate the reduction of the screen by two bays. Appeal dismissed.

Re St John the Baptist Saints Lawrence and Anne Knowle [2017] ECC Bir 1

In 2009 the lead rainwater goods on the north side of the church were stolen and were replaced with like materials, which in turn were stolen in 2011. In 2012, in view of water ingress and damage to internal walls, the church sought approval for the immediate installation of GRP rainwater goods. The Diocesan Advisory Committee and English Heritage were unhappy about the use of GRP on a Grade I church. In July 2012 the Deputy Chancellor granted a temporary licence for GRP rainwater goods, subject to conditions. GRP rainwater goods were installed and the Church subsequently applied for a confirmatory faculty.The planning authority, SPAB and the Church Buildings Council objected to GRP. The Chancellor granted an interim faculty, allowing the GRP rainwater goods to remain for a further 5 years, after which they should be replaced with metal, if the general advice of the heritage bodies has not changed by the end of that period.

Re St John the Evangelist Filey [2011] Peter Collier Ch. (York)

Faculty granted for extensive re-ordering, including removal of pews, new internal entrance lobby, moving of the font to a new position and introduction of a new sound reinforcement system.

Re St Margaret & All Hallows Orford [2022] ECC Liv 1

The Chancellor declined to grant a faculty to permit the exhumation of the petitioner's grandfather's cremated remains from the churchyard at Orford and reinterment in the grave of his wife in Warrington Cemetry. No sufficient exceptional circumstances had been shown: the petitioner's grandfather had died 18 months after his wife had been buried in the cemetery and the family (who said that they had mistakenly thought that his remains could not be buried in the same grave as his wife, who had been a Roman Catholic) had decided to have his remains buried in Orford churchyard; a long period of time (21 years) had elapsed since his death; and there was no support for the exhumation from the parish.
